Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and AFARCO ("we", "us", "our"). By accessing our website, creating an account, submitting an order, or otherwise engaging with our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

Our products and services are intended for business and professional use. By placing an order you represent that you are at least 18 years old and have the authority to bind your organization to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity performed under your account. Notify us immediately of any unauthorized access.

AFARCO designs and supplies SMT placement systems, feeders, and related industrial automation components, along with engineering, integration, and support services.

Product specifications, photographs, and performance data are provided for reference. Minor variations resulting from continuous improvement, manufacturing tolerances, or configured options may apply. The authoritative specification for any given order is the one stated in the final quotation or sales contract.

All orders are subject to written confirmation by AFARCO. Prices shown on the website are indicative and may be updated without prior notice; binding pricing is provided in your quotation.

• Quotations are valid for 30 days from issue unless otherwise stated.
• Taxes, duties, and shipping costs are calculated separately based on destination and incoterms.
• Payment terms are defined in the quotation or sales contract. Late payments may incur interest at the maximum rate permitted by applicable law.
• Title to goods transfers only after payment is received in full; risk of loss transfers per the agreed incoterms.

Estimated lead times are communicated at quotation and are not guaranteed. AFARCO is not liable for delays caused by carriers, customs, force majeure events, or other circumstances beyond our reasonable control. Upon arrival, the Customer must inspect the shipment and report visible damages or shortages within 7 days.

AFARCO products are warranted against defects in materials and workmanship for 12 months from delivery, unless a longer term is specified in the contract. Warranty service is limited to repair or replacement of defective parts at our discretion.

The warranty does not cover damage resulting from misuse, unauthorized modification, improper installation, inadequate maintenance, environmental conditions outside specifications, or use of non-approved consumables or spare parts.

Because our products are built to order and configured for specific production needs, returns are accepted only for items shipped in error or confirmed defective on arrival. Contact our support team to initiate a return authorization before sending any item back; unauthorized returns will not be accepted.

All content on our website — including product designs, images, text, logos, datasheets, and software — is the property of AFARCO or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Purchasing a product does not grant you any rights to the underlying designs, firmware, or software beyond the license needed to operate the product for its intended purpose.

You agree not to use our website or services in any way that:

• Violates applicable laws, regulations, or third-party rights.
• Introduces malware, attempts to gain unauthorized access, or disrupts the operation of our systems.
• Scrapes, harvests, or otherwise extracts data in bulk without our written permission.
• Misrepresents your identity, affiliation, or intent.

Except for express warranties stated in these Terms or in a signed sales contract, our website, products, and services are provided "as is" and "as available" without any warranty of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, AFARCO and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost production, data loss, or business interruption — arising out of or related to the use of our products, website, or services, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or related to an order will not exceed the amount actually paid by you for the product or service that is the subject of the claim.

You agree to indemnify and hold AFARCO and its affiliates, officers, employees, and agents harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of our products, or your violation of any law or third-party right.

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or any transaction with AFARCO will be resolved through good-faith negotiation and, failing that, by the competent courts in Ho Chi Minh City, Vietnam — unless an alternative forum is agreed in writing.

We may update these Terms from time to time. Updated Terms will be posted on this page with a new "Last updated" date. Continued use of our website or services after such updates constitutes acceptance of the revised Terms.
